George Anderson's 101 Page Will / Probate and a Twist to this Story

In March 2015, I contacted Dane County, Wisconsin for copies of a will and probate records pertaining to George Anderson (he died Jan. 10, 1879 at the age of 94). He was my third great-grandfather, born in New Jersey. Months later, I learned that the entire probate packet was 101 pages long. I just read those pages this past week, his will is below, transcribed by me, followed by the actual copy, and the correspondence to the courthouse. There is no need to read it until you get to September. (I included it for my documentation.)

It took almost a month to get the exact copies I needed from the courthouse. There is a big twist to this story because six months after I initially wrote, I made a discovery. If I had waited until September, I could have saved some money and a whole lot of time and no confusion.

The Will and Codicil

I George Anderson of the town of Sun Prairie-Dane County, Wisconsin being of sound mind and memory and mindful of the uncertainty of human life do make publish and declare this my last will and testament.

First—That all my just debts and funeral expenses be paid.

Second—I give grant devise and bequest unto my well-beloved wife Euphemia B. all my property and estate real and personal for and during her natural life for her comfort and support. It is my will and intention that she use and dispose of the personal property for her own support as she may find necessary or convenient and that she has the use occupation and income of the real estate but it is not my will or intention that she should sell or incubus the real estate.

Third--As a token of my affection and remembrance I give to each of my sons who may be living at the time of my death, the sum of seventy dollars To Wit-Simone Anderson—George W. Anderson—Richard L. Anderson—Cornelius Anderson and Jeremiah T. Anderson to be claimed and paid within one year after my decease and if not claimed within that time to go to the body of my estate.

Fourth—It is my will that all my property and estate real and personal remaining at the death of my said wife Euphemia B. shall be equally divided between my two daughters. To wit Martha Maria Adams wife of Liberty Adams of Genesee County and State of New York and Jane Maria Peckham wife of Benjamin Peckham of Sun Prairie Dane County Wisconsin and I hereby give grant devise and bequest all my estate real and personal which shall remain at the time of the death of my said wife to my said daughters to be divided equally between them and share and share alike—And in case my said daughters or either of them shall not be living at the time of the death of my said wife then the share of such daughter so deceased shall descend and go to the child or children of such deceased daughter or the lineal descendant of any deceased child or children of such deceased daughter in the same proportion as they would inherit by law. It is my intention that this will shall embrace and include all property of which I may (unfortunately, I can't determine the words underlined in red, if you know, please let me know. Thank you.) or in any manner by entitled to either by inheritance or otherwise at the time of my death. It is my will and intention that my said wife

shall use only so much of the personal property as may be necessary for her own support first using the income of the real estate and from real property and in case that shall be found insufficient for her support then she may use so much of the principal of the personal estate as may be necessary for her suitable and comfortable support the reminder and residue to go to my said daughters or their descendant as hereinbefore mentioned Fifth— I hereby appoint my said wife Euphemia B. Anderson executrix of this my last Will and Testament and authorize her to compromise and settle any claims or demands which may be against or in favor of my estate. Thanks for your patience.  I do sometimes make duplicate copies, just to make sure if you can't read something on one of the copies, you will be able to on another.  Of course, you'll only be charged one copy fee.

I've attached a copy of the court docket entries to this email to help you determine what additional documents you would like copied.  I don't know why I didn't think of doing that before I went on vacation...but there it is.

I did also take a quick look at the microfilm again...most of the documents are 1 or 2 pages long...just a reminder that our copy fee is $1.00 per page and there will be a $4.00 search fee as well.

I'll wait to hear back from you which additional documents you would like copied.  I did notice if I blow up the size of the page, it's a little easier to read.

Could you tell me the title of the film and 1st-page number? (I'd like the source.)

My pages are the electronic ones or do you send hard copies?

Barbara, your comments are funny, as my first job with Dane County Clerk of Courts some 30 years ago was preparing files to be microfilmed and then checking the films once they were developed to make sure everything was legible.  I do have much more variety now : )

This case is on Dane County Circuit Court Probate Film 171-A-98 and is the first case on Index #4 which is Box 268.

I'm coming up with 11 pages for the number of copies...the last page is just one of those covers that used to get filed with documents indicating what was being filed...so I won't charge you for that.  I have attached our invoice to this email for the search and copy fees.  Payment instructions are on the invoice.  If you choose to mail a check please enclose a copy of the invoice with it.  I just saved the documents from the microfilm right to a PDF, so I didn't print out any hard copies.

I'm glad you were able to get some useful information from these records.  Please let me know if you have any other questions.

I must share this with you. Back in April, I requested a will of George Anderson's, and you provided it. Since there were a lot of pages in his packet, it took some time, but you did it.

Just today, I discovered that Ancestry.com just released millions of wills and probate records to subscribers. (I think it is free for this weekend.) Anyway, I found my George Anderson...all pages are crystal clear and clean, all 101 pages! I thought you would be interested in this, and maybe get a chuckle.

Hi Barbara,

I do find this interesting...especially the fact that the copies were so clear.  I wonder where they obtained the copies...maybe they have better equipment to print from microfilm than we do.  Plus the fact that you got all of these additional documents for free is awesome!

This is information I'll pass on to other people requesting records from us...as I just had someone requesting some old probate records that were difficult to copy.

When I read of Ms. Dorothy Ann Koenig’s passing a few days ago, from the California Genealogical Society and Library facebook page, I knew I had to write something about Dorothy.

Let me take you back to how and when we connected. Fortunately, Dorothy replied to a query on RootsWeb in 2001, and I found it in November 2008, when I was looking for some information. Her email didn’t work for me, and I was determined to find her so, how did I get it? I am sharing some of our letters to give you insight into what a wonderful generous lady she was. If you’ve never written a genealogist for help, you might be missing out. She helped me solve a major brick wall, the ancestry of my 3rd great-grandfather, I couldn’t have had a better person to guide me along. Back in 2001 you replied to several RootsWeb queries and sourced the book, "A Genealogy of the Reyniersen Family" and that is the purpose of my email to you. I can't locate it in my area (Massachusetts) and wondered if you had a personal copy of it?  My line is, I believe, Simon Anderson, then his son George who married Violetta Ten Eyck.

I do know the book is in Salt Lake City, but as is always the way, I was there three weeks ago, but then, didn't know that Anderson was in the book.

On another note, I see we both know Steve Danko, as a matter of fact, he gave me your email, as the 2001 address didn't work and this email was returned to me.  Thank goodness for your name + genealogy I found you through Google and Steve.

When you wrote the below, is that all that there is in the book that pertains to the Anderson line?

Dear Barbara,  I'm glad that you were able to locate me!  The book in question is "A Genealogy of the Reyniersen Family", by Peter M. Rinearson and Arthur P. Rynearson published in 1997. It is page 67 that has the information about the family group of Simon Anderson and his wife Maria/Mary Van Anglen. Maria was the daughter of Cornelius Van Hengelen and Sarah Reyniersen.  Simon was the son of George Anderson and Mettie Van Wickle (sic). The birth and death dates for individuals in the family are given.  For your George (the son) the birth date of 8 March 1796 is given. He was baptized on 3 April 1796 in the First Dutch Reformed Church in New Brunswick, NJ.

These New Brunswick baptisms have been published in the Proceedings of the New Jersey Historical Society. I can confirm that little George's baptism took place on 3 April 1796. The parents' names were recorded as "Simon Aderson (sic) and Mary Van Hengler.

I am the editor of a genealogical quarterly, "New Netherland Connections".  When the Reyniersen book was published on 1997, one of the authors contacted me, and I immediately purchased a copy. I guess the print run was rather small, and now I own a treasure :-).

        Dear Barbara,  Yes, I think you are on the right track.  My basic impression is that your George Anderson, son of Simon, either didn't know exactly when he was born OR that as time went by he exaggerated his age. The ages of George and his siblings as presented on page 67 of the Reyniersen Genealogy come from a handwritten copy of a family Bible record. (See pages 831-833 of volume 2 of "Genealogies of New Jersey Families" [1996]). The whereabouts of the original Bible is unknown today:

"In the year 1755 was Simon Anderson Born on the 10 Day of December.

In the year 1761 was Mary Van Anglen Born On the 30 Day of November.

In the Year 1783 was Martha Anderson Born on the 4 Day of June.

In the Year 1785 was Sarah Anderson Born on the 25 Day of August.

In the Year 1787 was Dinah Anderson Born on the 8 Day of August.

In the Year 1789 was Jemima Anderson Born on the 8 Day of December.

In the Year 1796 was George Anderson Born on the 8 Day of March.

In the year 1799 was Cornelius Anderson Born on the 2 Day of March.

In the year 1806 December 21 then Simon Anderson Departed this Life in the fifty second [year] of his age."

From the same source we also learn:

"In the Year of Our Lord 1802 in Martha [Anderson] Married to Hendrick Suydam October the 16th Day.

In the Year of Our Lord 1803 is Sarah Anderson married to Garret Stothoff on the 18th of September.

In the Year of Our Lord 1804 the 9th of September Jarominah Anderson Departed this Life in the 15th Year of her Age."

There is more on the earlier generations of this ANDERSON family on pages 371 and 372 of the same volume.

On page 5 of "New Jersey Marriage Records, 1665-1800", by William Nelson, 1990, we learn that "Simon Anderson, Somerset" and Mary Van Hauglin" received a license to wed on 11 October 1781. (I am sure that the "u" in Mary's surname is a mis-transcription of an "n" that was in the handwritten document.)

Then I found an abstract of Simon Anderson's will on page 9 of New Jersey "Calendar of Wills,1806-1809". He wrote his will on 10 November 1806, and we know from the Bible record (above) that he died on 21 December 1806. The will was proved in court on 7 January 1807.

"Simon Anderson, of Raritan River, Somerset County, yeoman, will of. Wife, Mary, use of real estate and residue of personal estate, while my widow; should she marry, then 30 Pounds yearly, during her life. Sons, George and Cornelius, lands whereon I now live that my father bought of Albert Voorhees (325 acres). Son, George, negro man, Nene, my silver hilted sword, silver watch and 6 silver tea spoons. Son Cornelius, negro man, Will; should he die underage and without issue, 1/2 of his share to my son George, and the other half to be divided among my daughters.  Daughters, Martha and Sarah, each 250 Pounds. Daughter Dinah, 300 Pounds; should she died without issue her share to be divided between all my children. Sons, George and Cornelius, cattle and farming utensils.

Executors -- wife, Mary, and son-in-law Hendrick Sedam [Suydam].

Witnesses -- Richard Rappleye, James Rappleye, Cornelius Rappleye"

There is something particularly poignant about this will when you consider that Simon Anderson's two sons -- George and Cornelius -- were only about 10 and 7 years old when their father wrote his will and died.

What exact volume and page of the "Somerset County Historical Quarterly" shows the first marriage of your George Anderson to Violetta Ten Eyck?

This morning, I was looking at your New Netherland Connections books through the NEHGS site, how easy it that, on a cold Sunday morning. The first volume explains what New Netherland means, I never knew, and always wondered. And, my TenEyck line, I always thought they were Dutch, but similar to your example (but in reverse), later discovered that they were German.

Do you think Anderson is a Dutch name? Of course what was written about the family in the Genealogies of New Jersey Families, may give some information on that.

You asked me about Violetta and George's marriage, the below came from Mary Hobein.

"Somerset County Marriages (Somerset Co. LDS microflim 1023875 also in Somerset County Historical Quarterly)

George Anderson and Violetta Ten Eyck Nov 31, 1816 (John Boggs)"

And from a webpage (person contacted, but no reply) Alletta Teneick (daughter of Jeremiah Teneick and Jane) was born September 22, 1797, and died 1840 in Dane Co., WI. She married George Anderson on November 28, 1816.

What an undertaking to do such a large book of 600+ pages, and then a second book. For now, I will wait on writing Mr. Rynearson, as I know the book will be at least $60 or more. Of the four libraries that I contacted, the first two replied with a no, but one said yes, and the other NYPL said to send request to another place. So, I will continue with the inter-loan process for now.

The Three Unique Sources Didn't Prove Anything

George Anderson, my 3rd great-grandfather, has been a mystery to me ever since I saw the chart on the left for my father showing his ancestor was Major George Anderson. I've been very curious about his title for 25 years.

I've traced George's ancestry from his 1784 New Jersey birth back four generations. I know the names of his three wives and his nine children. This information was rather easy to find, thanks to 3 federal censuses, a state census, a book on his ancestors called, A Genealogy of the Reyniersen Family, several historical books, and the selfless help in 2008 from Dorothy Koenig, editor of the New Netherlands Connections. He died at age 94, so there was a lot of information out there, but not what I'm looking for.

The one thing missing is actual proof that George Anderson was a Major. As mentioned above, he was named Major George Anderson  in many sources I used. Such as: a small genealogy outline done by my mother, a death notice in a book I located in Salt Lake City, various pages from a manuscript I obtained from Rice University in 2009 (the word Major was written three times), a brief mention from an index card in the file of the Wisconsin Historical Society. Written on the card was, "Silver hilted dress sword worn by the grandfather of Maj. George Anderson." All these sources were useful, but I still don't know why he was called a Major.

When three new sources came my way this year, I decided my challenge would be to find proof if George was really a Major. My blog played a big part in getting help because of two new readers who helped me. The first reader was a distant cousin who googled our shared ancestor's name; the second reader enjoyed something I had written and left a comment (it had nothing to do with genealogy). Our correspondence led to my accepting a subscription to GenealogyBank.com. The third source involved George's will (I saw a better copy than the awful one I had received several months prior, thanks to Ancestry.com). Below, are the three steps I took to find information from my new sources.

In March, I received an email from Mattie, inquiring about my Adams line. As fate would have it, she is my third cousin and I was very familiar with her family. I never contacted anybody on that line because I felt I had all I needed. She mentioned a manuscript her grandfather had written and there were parts about Major George Anderson in it. Within a week, I had her typed 28 page booklet. I quickly made copies and sent it back to her. That information, though didn't solve my question as to why he was a Major, set me on the path to once again work on his line.

The next logical step was to try and find a will. The next month, I contacted the Deputy Clerk Dane County Circuit Court Record Center in Madison, Wisconsin to inquire about a will, then to get copies of it. The clerk called me after they received my written request, because the probate packet was so large. She needed to discuss what I wanted, since I had no idea, I decided on the first 14 pages (neither of us knew how large the packet was.) I paid $1 a page for an electronic image. The images were horrible and so were the copies I printed outs. I put the will matter aside until one day in September I received notice that Ancestry.com released the Wisconsin, Wills and Probate Records, 1800-1987. Within minutes of putting in his name and state, there was his file, a file with 101 pages!

All the probate records turned out to be crisp and clean and I could read about 99% of it. I was lucky George had a will and a codicil. The contents won't be discussed because I plan on doing a post covering two interesting I discovered. What I was happy to find were the words Major Anderson written twice, as seen below. Only 2 pages out of 101 pages has this title.

The third bit of information regarding the name of Major George Anderson came from GenealogyBank.com. Within an hour of logging on, I was lucky to find death notices in newspapers for two of his three wives (died 1840 and 1878), and the best thing was finding George's 1879 death notice two weeks after his 3rd wife's death! Below shows the snippet of his death, and I immediately clicked on it to open it.


Seeing Major written in the above snippet for the Wisconsin State Journal was like finding the pot of gold, and it confirmed my other notice of his title and death which is shown below. As I mentioned, I also found death notices for two of his wives. The first wife, my direct line ancestor died in 1840, but I had no idea in which state, until I saw the notice. (Her children were born in 4 different states.) The notice also provided me with her father's name by printing she "was the daughter of, Capt. Jeremiah Ten Eyck of Middlesex co., N. J."

In 2008, while at the Family History Library in Salt Lake City, Utah, I found the following information: "Maj. George Anderson died at Madison, Jan 10th in the ninety-fifth year of his age. He was born on the banks of the Raritan, New Jersey, March 8th 1784; and after residing successively on Staten Island, in Pennsylvania and Illinois, he settled in Dane County in 1839 and spent most of his life as a farmer. While residing in Madison, he served two years on the Board of Aldermen, and several years as Supervisor in the County Board, serving in the latter capacity at the time of his death. He survived his third wife two weeks. He was a gentleman of the old school, enjoying good health and a bright intellect almost to the last."

Was George in the military? I still don't know, but I doubt it because over the course of many years, I haven't found any indication that he was. As you can see, it often takes many years and many sources to get a pretty good picture of somebody's life, but until you know everything about the person, the research should continue. It also helps to have an interested cousin and a helpful reader, thank you both.


As an after thought, I've decided to show his marriage record for 1841, when George married his second wife.

To those who kindly responded with helpful ideas.
I re-read the will of George's father, Simon and it mentions son George four times. It also said, :Sons, George and Cornelius lands whereon I now live that my father bought of Albert Voorhees (315 acres). Son, Georege, negro man, Nene, my silver hilted sword, silver watch and 6 silver tea spoons." (His other son also received a negro man.) Now I know where the "silver hilted sword" came from.
I also put in the name of Major Anderson (as his first name) on Ancestry.com and he didn't come up. My finding, he was named George, not Major.

There is also a write-up about him, and in-part, it reads," Major Anderson has held several offices, the duties of which he has faithfully and honestly discharged. He was for several years supervisor of the town of Sun Prairie, chairman of the county board, under-sheriff three years, collector of taxes of Dane and Sauk counties, and settling his accounts without making a mistake. He was also deputy United States marshal. He is now living in comfortable retirement upon the interest of the money his industry and economy have enabled him to accumulate. Major Anderson's natural capabilities enabled him to enjoy the full benefit of the society of such cultivated gentlemen as Nicholas Biddle, John C. Craig and W. R. Johnson of Virginia, with whom he was intimately connected in business for five years, and his retentive memory enables him to narrate many interesting incidents characteristic of those gentlemen. In illustration of the ready wit and imperturbable self-possession of Colonel Johnson he relates that on his return to Philadelphia from New Jersey, when the great race between Mr. Johnson's horse Boston and Mr. Gibbon's mare Fashion had just been run, and while still on the crowded ferry-boat, Colonel Johnson felt some one's hand in his pocket, and instantly clasping and holding it, turned his head and said, "My friend Mr. Gibbon won the race to-day." Although Major Anderson is in his ninety-second year, his bodily health is I good, his mind cheerful, his manners easy and dignified, and looks very like, as he is, a gentleman of the olden time. His present vigor of mind and body is an eloquent commentary upon temperance, industry, and cheerfulness, that badge of a gentleman. If the prayers of his friends avail he will complete a century."

It took 15 years to locate substantial information about George Anderson, and my first clue came from the book above. The above isn't an obituary but a death notice. I was alone in the Family History Library in Salt Lake City, with lots of people, but nobody to share the news with. Now two years later, I can say, it was simply thrilling, and I still get a natural high when I think about that day.

Monday Madness -- Jamboree and my "Brick Walls"

Many years ago, at least 13, I prepared the below flyer to be posted to a wall at a Jamboree.  I mailed it, assumed it was posted and never heard from anybody.  No problem with that.  However, I am wondering if this was for the same Jamboree coming up soon.  When I located this gray sheet recently, I began to wonder, and with all my senior moments, I thought somebody could remember for me.

How I solved my Anderson "Brick Wall"

The Anderson line was a "Brick Wall" until 18 months ago, when it was solved with the help of information from an April 2000 message board. Another person was working on their Anderson line eight years ago, and putting all the records she found on that same message board. A lady named Dorothy had helped that person out. I felt that that some of the information could tie into my line, but I needed help, as Dorothy had a copy of a limited edition of a 660 page genealogy, that had my names.  It was a wise move to contact her, because the book had all the sources too, and she is pretty much an expert on New Netherland families.  She sent me copies of all the pages I needed, and the rest is history.  You never know how or when your "Brick Wall" will come down, but when it does the feeling is simply wonderful.  Thank you Dorothy.

Even locating Dorothy was easy, although her email was no longer in service. A google search showed that she was a member of a genealogy club, and Stephen Danko attended meetings there. Within days, after contacting him, I had her email address. After a quick email to her with all the facts, she wrote back, saying, "I'm glad that you were able to locate me!"  So you can see, I used quite a few methods to solve my mystery.
